Appendix A, B, C, D and E of this report are not for publication as they contain exempt information of the description in14 (Information relating to the financial or business affairs of any particular person including the authority holding that information) of Part 4 and satisfies the public interest test in paragraph 21 Part 5 of Schedule 12A of the Local Government Act 1972

AGREED: That the Liability, Motor, Property and Miscellaneous insurance policies, including claims handling arrangements, be renewed for a 12 month period from  April 2018 to 31 March 2019

Appendices 1, 3, 4, & 5 of this report are exempt from publication because they contain information of the kind described in paragraphs 14 and 21 of parts 4 and 5 of Schedule 12A to the Local Government Act 1972.

The decision has been certified by the Monitoring Officer as urgent because any delay likely to be caused by the call-in process could seriously prejudice the Council and is in the public interest under section 13 of the Scrutiny Procedure Rules and the call-in procedure does not apply to it.

RESOLVED: that

 (1)    in principle the Metro Delivery Partnership collaboration agreement as set out in Confidential Appendix 1 be approved and authority be delegated to the Director of Economic Development in consultation with the Cabinet Member for Investment & Development and the Cabinet Member for Finance, Modernisation and Performance, the Section 151 Officer and the Monitoring Officer to negotiate and conclude all aspects of a final agreement with Welsh Government and the developer for delivery of the new Central Bus Station.

(2)     the disposal of the leasehold interest in the land marked red and acquisition of the land shown coloured blue in the site plan attached as Appendix 2 be approved to support delivery of the new Central Bus Station on the terms set out in Confidential Appendix 1 and in line with the independent valuation provided at Confidential Appendix 4.

RESOLVED: that

1.  the undertaking of a feasibility study as required by the legal direction from Welsh Government be approved;

2.  authority be delegated to the Director of Planning, Transport & Environment, in consultation with the Cabinet Members for Clean Streets, Recycling & Environment and Strategic Planning & Transport, to commence the procurement of a specialist consultant to undertake detailed modelling to support the feasibility study, including the issuing of documentation; and deal generally with all aspects of the procurement process and ancillary matters up to and including award of contract;

3.  the publication of the Transport and Clean Air Green Paper be noted and that it be referred to Full Council for debate.

Appendix B of this report is exempt from publication pursuant to the provisions of paragraph 16 of Part 4 of Schedule 12A of the Local Government Act 1972

AGREED: that subject to confirmation of funding from Welsh Government:-

1)    the extension by 12 months of existing contractual arrangements be authorised for the provision of housing related support services funded by the Supporting People Programme (SPPG) with each of the 23 support providers as set out at Appendix A, with such extension to commence upon 1 April 2018; and

2) the extension by 3 months of the existing contractual arrangement with Taff Housing Association Limited referred to in paragraph 11 of the report be authorised with such extension to commence upon 1 April 2018

AGREED: that

1)   the procurement process be authorised in order to establish and operate a Dynamic Purchasing System ( 'G DPS") for the provision of Passenger Transport services.

2)   the issuing of the OJEU notice be authorised in order to formally commence the procurement process and to keep the OJEU notice "live" during the term of the DPS (which is anticipated to be for a term of seven years);

3)   the selection evaluation criteria be approved to establish the DPS as set out in paragraph 10, 12 and 13;

4)   the award criteria to be used to allocate routes to providers once the DPS is in place which for the avoidance of doubt will include the use of reverse e-auctions in relation to lots 1, 2 and 4 and lots 3, 5, 6 and 7 closed lowest price bids be approved.

Appendices 1 and 2  3 and 4  to this report are exempt from disclosure as they contain information pursuant to paragraphs 14, 21 and paragraph 16 of the Local Government Act 1972.

AGREED: that the formal termination of the existing Agreement for The Hayes Large Format Outdoor Advertising site with SuperSpace Ltd be approved.

Apologies for absence were received from Councillors Bale, Bowden, Bridgeman, Carter and Stubbs.

The Monitoring Officer and the Chair of the Children and Young People Scrutiny have agreed the decision should be taken on an urgent basis, and is therefore not subject to call-in.

AGREED that the Instrument of Government, as attached to the report, is made according to The Federation of Maintained Schools (Wales) Regulations 2014.

Appendix 2 is exempt from publication pursuant to the provisions of Schedule 12A Part 4 paragraph 16 of the Local Government Act 1972

AGREED: that the Council enter into a partnership agreement (in the form of the draft agreement attached to Appendix 1) with the Vale of Glamorgan Council and the Cardiff and Vale University Health Board, with such agreement to commence upon 1 April 2018.

AGREED: that

1. the proposed variation of the existing Disability Focus contract be authorised by way of an extension in part as referred to under paragraph 17 of this report, with such extended period being for a term of 12 months commencing upon 1 April 2018.

2. It be noted  that the welfare benefits advice element of the services under the existing Disability Focus contract will come to an end on 31 March 2018 and that these services will be delivered by the Council’s in house team from 1 April 2018 as detailed under paragraph 14 of the report.

3. the variation of the current Service Level Agreement  in place be authorised for the Families First Child and Youth Engagement Services, by way of an extension in part as referred to under paragraph 19 of this report, with such extended period being for a term  of 12 months commencing upon 1 April 2018.

4. the letting of a grant agreement between the Council and Cardiff and Vale University Health Board be authorised to enable the said Health Board to deliver specialist elements of services in support of the Families First programme, with such grant agreement to be let for a term of 4 years commencing upon 1^st April 2018.

AGREED: that the collaboration  Agreement for the Regional Social Care Workforce Training Unit between  Cardiff Council and the Vale of Glamorgan Council be entered into and to commence upon 1 April 2018, with such agreement to be substantially upon the terms as set out in the draft agreement attached to Appendix A  of this report

Appendices 1 & 2 of the report are not for publication as they contain exempt information of the description in paragraph 14 of Part 4 and paragraph 21 of part 5 of Schedule 12A of the Local Government Act 1972.

AGREED: the property be disposed of by way of an off market sale to Cardiff & Vale University Health Board at a price defined by the independent valuation as outlined in the attached Report (Appendix 2).

The Corporate Plan forms part of the strategic policy framework set out within the Council's Constitution and is considered annually by the Council. The document outlines the organisation’s strategic policy priorities and forms part of the required statutory improvement framework as it discharges the Council’s obligations under the Local Government (Wales) Measure 2009 to publish a stage one plan, which sets out how the Council plans to achieve its priorities for improvement. The Corporate Plan usually covers a 3-year period and is subject to an annual refresh.

            RESOLVED: that

1.            the Corporate Plan 2018-21 be approved for consideration by Council on 22 March 2018; and

2.            Council be recommended to delegate authority to the Chief Executive, in consultation with the Leader of the Council, to make any consequential amendments to the Corporate Plan 2018-21 following consideration by Council on 22 March 2018 and prior to publication by 1 April 2018.

Appendix 3 is not for publication as it contains exempt information of the description contained in paragraphs 14 of part 4 and paragraph 21 of part 5 of Schedule 12A of the Local Government Act 1972.

RESOLVED: that authority be delegated to the Director of Economic Development in consultation with the Cabinet Member for Investment and Development and statutory officers to acquire the leasehold interests in the Toys ’R’ Us site shaded blue on the plan attached at Appendix 1, on the terms set out in Confidential Appendix 3 and subject to a full independent valuations.

RESOLVED: that the Cardiff Capital Region Joint Working Agreement Business Plan be commended to Council for approval in the form attached as Appendix B to the report.

Cardiff Well-being Plan sets out the Cardiff Public Service Board’s priorities for action over the next 5 years, and beyond. The plan responds to the evidence set out in its Well-being Assessment and focusses on the areas of public service delivery which fundamentally require partnership working between the city’s public and community services, and with the citizens of Cardiff.

As required by the Well-being of Future Generations (Wales) Act, each member of the PSB must confirm its approval of the plan for publication.

RESOLVED: that the Well-being Plan is approved for consideration by Council on 22 March 2018

In accordance with Section 89 of the School Standards and Framework Act 1998 and the Education (Determination of Admission Arrangements) (Wales) Regulations 2016 the Council is required to review the School Admission Policy annually.

The School Admission Arrangements must be determined for implementation in September 2019.

RESOLVED: that

1.            the attached Council’s draft School Admission Arrangements 2019/2020 as set out in the Admission Policy 2019/2020 be determined.

2.            It be noted that the School Admission Arrangements 2019/2020 implement Option A for admission to secondary education, as set out in the Admissions Arrangements Consultation Document (Appendix 2).

3.            It be noted that Cabinet will receive a subsequent report on revisions to school catchment areas for 2020/2021.

The coastal defences across Cardiff’s foreshore are in very poor condition and erosion is already taking place at a rapid rate.

An Outline business case has been produced aiming to improve the existing coastal and fluvial defences to provide improved protection to people and property in southeast Cardiff from coastal erosion and flood risk, and prevent the erosion of two decommissioned landfill sites and Rover Way adopted highway.

Much of the coastline across the project area is eroding and with predicted sea level rise due to climate change, the flood and erosion risk will increase into the future. The proposed scheme will manage flood risk to 1,116 residential and 72 non-residential properties over 100 years, as well as preventing further erosion. The scheme is a combination of rock armour, raising of embankments and sheet piling.

Approval is being sought for the project to proceed to Detailed Design as part of the Welsh Government Coastal Risk Management Programme.

RESOLVED: that

1.          the detailed design and construction of the coastal defences valued at £11M be procured.  The funding to be provided on an apportionment of 75% funded by Welsh Government and 25% by Cardiff Council.

2.          the 25% funding required to deliver the coastal defences be committed in line with the Welsh Government Coastal Risk Management Programme.

3.          a reassessment of the scheme be undertaken following the completion of the detailed design to confirm financial implications of construction and viability.

To agree the Cardiff and Vale of Glamorgan Area Plan and Area Action Plan for Care and Support Needs

RESOLVED: that

1.      Cardiff and Vale of Glamorgan Area Plan (as set out in Appendix 1) be approved.

2.      The Area Action Plan (as set out in Appendix 2) for Care and Support Needs 2018-2023 be approved.

Issues covered in the HRA Business Plan are to:

•     set out the authority’s purpose or mission as a social housing landlord;

•     set out objectives and standards for the service;

•     plan how to achieve the objectives and standards set out (the strategies);

•     plan resource and financial requirements;

•     provide a framework for monitoring and evaluating the progress of the housing ‘business’;

•     communicate the authority’s plans to its tenants, WG, other key stakeholders, partners and the wider community.

RESOLVED: that

1.            HRA Business Plan 2018-2019 be approved

2.            It be noted that the approved Plan will be submitted to the Welsh Government.

The busiest of the City’s burial sites will be full within the next 3 years. The report looks to seek Cabinet approval to utilise an area of existing Council owned land North of the M4 on the A469 for new cemetery space subject to planning approvals being granted.

To give delegated authority to officers to take forward a planning application for the site and deal with the termination or adjustment of an existing agricultural lease attached to the land.

RESOLVED: that

1.            the submission of a planning application be supported to seek the necessary consent for development of the site situated on the A469 north of the M4 and identified on the attached map as Appendix 1 as a municipal cemetery.

2.            officers seek to negotiate a surrender of the current tenancy agreement by the leaseholder in order to take back the required land at an earlier date and subsequently serve the necessary termination notice in respect of the tenancy.

The Welsh Government's has launched a new Targeted Regeneration Investment Programme, which presents an opportunity to apply for capital funding to support economic regeneration projects over a 3-year period from April, 18.

A regional regeneration plan needs to be in place, prior to project proposals being put forward for consideration under the new programme. This report seeks in principle approval for this Authority's input into the regional regeneration plan, in order that the regional framework can be finalised.

RESOLVED: that

1.            It be noted that the funding opportunity presented by the Welsh Government’s Targeted Regeneration Investment Programme and associated match-funding requirements;

2.            priority themes and projects for the Targeted Regeneration Investment Programme set out in the report be agreed;

3.            Authority be delegated to the Corporate Director, People and Communities, Director of Economic Development, and Director of Planning, Transport and Environment, in consultation with the Cabinet Member for Housing & Communities, Cabinet Member for Investment and Development and Cabinet Member for Strategic Planning and  Transport, to finalise details of the Council’s contribution to the Regional Regeneration Plan and prepare funding bids for consideration under the Targeted Regeneration Investment Programme.

The Council also has a statutory requirement under the Localism Act 2011 to prepare a pay policy statement on an annual basis. The first' statement was in' place by 31st March 2012 and they have been produced annually since. Agreement (and subsequent publication) of this seventh annual Pay Policy Statement will ensure continued compliance with this legislation.

RESOLVED: that

Cabinet approve the attached Pay Policy Statement 2018/19 (Appendix 1) for consideration by Council on 22 March 2018 and note:

(i)            the employer’s pension contributions have been included in the calculation of an employee’s weekly pay, where appropriate

(ii)          that the Council will need to take steps to implement changes arising from the NJC for Local Government Pay for 2018/20

(iii)         the inclusion of the Gender Pay Gap report

(iv)         the commitment to the principles and guidance on the appropriate use of non-guaranteed hours arrangements in the devolved public services in Wales, as developed by the Public Services Staff Commission in social partnership with the Welsh Government’s Partnership Council and its sector groups. 

The purpose of the report will be to obtain formal authorisation to write off National Non-Domestic Rate debts which are in excess of £100,000 in value. The request is made in accordance with Part 3, section 2, of the Cardiff Council Constitution, Executive Decision making function number 20. The debts to be written off exc.eed the level at which officers have delegated powers to deal with, and therefore authorisation is required from the Executive.

Appendices A and B  to this report are exempt from publication by virtue of paragraph 14 of Part 4 and paragraph 21 of Part 5 of Schedule 12A of the Local Government Act 1972

RESOLVED: that the write off of debts amounting to £508,959.09 be authorised.

AGREED: that sites at Willowbrook Drive and Willowbrook Park which have been declared as surplus to requirements as public open space be appropriated to the Housing Revenue Account for social housing development.
