Annual Uplift For Supported Living And Extra Care Block Contract Providers, And Other Adult Commissioned Services, And Real Living Wage Uplift For Eligible Staff In Regulated Commissioned Services.

 

Agreed: that

 

Supported Living Scheme and Extra Care Block Contracts

           agreement be given to authorise an uplift for the following services commissioned by Adult Services, that combines a CPI uplift on the core contract price, in line with the terms and conditions of the contracts, and reflects the additional costs related to the implementation of the RLW. The uplift rate will reflect CPI at the date specified in the contract, which is payable at the time of the contract anniversary commencement date, and will incorporate an additional 2.94% to reflect the differential between the increase in NLW costs and RLW costs incurred from 1 April 2022, based on the workforce related costs of the overall contract price.

 

a.         Ty Onnen, Supported Living scheme for people with physical disability and sensory impairment;

b.         Ty Cornel, Supported Living scheme for people with substance misuse issues;

c.         Brithdir House, Supported Living scheme for people experiencing mental ill-health

d.         Cwrt Hir and Dol yr Hafren Supported Living Services for older people

e.         Llys Enfys and Plas Bryn Extra Care Services.

 

Learning Disability Supported Living Block Contracts

 

           Agreement be given to authorise a CPI uplift on the core contract price, in line with the anniversary of the contractual commencement date for the Learning Disability Supported Living Services commissioned by Adult Services from the following providers, in line with the terms and conditions of the contracts. The uplift rate will be in line with CPI at the date specified in the contract (i.e. July) which is payable at the time of the contract anniversary commencement date ( i.e. 1st November).

 

a.         Mirus

b.         Innovate Trust

c.         Dimensions

 

           Agreement be given to authorise a one-off interim payment to Mirus, Innovate Trust and Dimensions, to be awarded in the form of a grant, that is calculated at 4.2% on the salary element of the core contract price. The grant, which will be payable in this year only, is intended to cover increased workforce costs related to the implementation of the RLW, for the period from 1 April 2022 to 31 October 2022 ahead of the CPI uplift being awarded on the contractual commencement date for the aforementioned services.

 

           Agreement be given to offer an open book discussion to Mirus, Innovate Trust and Dimensions, on request, to review provider costs and sustainability issues in April 2023, if Providers are concerned that the CPI uplift does not sufficiently cover the increase in the RLW that will be required from that time.

 

Other Adult Commissioned Services

           Agreement be given to authorise an average estimated CPI uplift of 8% for the following services commissioned by Adult Services:

 

a.         The contractual arrangements in place for Adult Respite Care services.

b.         The spot contracts put in place in relation to the Day Services.

c.         The spot contracts in place in relation to the Supported Living Services provision of personal domiciliary care services for Adults receiving Mental Health care and support.

d.         The contractual arrangements in respect of commissioned Adult Placement Scheme.

e.         The arrangements in respect of commissioned Emergency Accommodation Service.

f.          The arrangements in respect of commissioned Advocacy Services.

g.         The arrangements in respect of the Finance Advocacy Service

h.         The arrangements in respect of the Direct Payments Support Service

i.          The contracts labelled under Third Sector Contracts.

j.          The arrangements for Supported Lodgings.

 

Administration of Uplifts

           Subject to Recommendations being approved, payment of the annual uplifts is backdated as usual, so as to take effect from 1st April 2022 in respect of all contracts with the exception of those listed in points (a), (b) and (c) below:

 

a.         The Supported Living Services provision of personal domiciliary care services for Adults with Learning Disabilities which will be uplifted with effect from 1st November 2022, in line with the anniversary of the contract commencement date.

b.         The Supported Living Services provision of personal domiciliary care services for adults with substance misuse needs which is uplifted with effect from 16th February 2023, in line with the anniversary of the contract commencement date

c.         The Supported Living Services provision of personal domiciliary care services for adults with mental health needs which is uplifted with effect from 29th June 2022, in line with the anniversary of the contract commencement date

 

The services listed in paragraph (a) will also receive a separate one-off grant payment that covers the period 1 April – 31 October 2022.

 

Variation in Contract

           Agreement be given to authorise that a Variation of Contract Form be issued to Providers in receipt of the Real Living Wage uplift (located at Appendix A), in order to secure their agreement to pay eligible staff at least the Real Living Wage from 1 April 2022.

·         payment of the published fee levels that reflects the host Local Authority’s agreed cost of care rate for care homes for all cohorts where available, unless the costs are already above this, in which case no uplift will be applied as per Cardiff Care Homes.

·         an uplift for Out of County care packages for other population groups, where there is no host LA rate, that reflects the Cardiff Council annual uplift level for those cohort of care homes.

Domiciliary Care Agencies

 

Authorisation be given to

 

·      an increase to the floor of the current Fee Setting Strategy for Domiciliary Care to a blended rate of £19.00 per hour.

 

·      an increase to the ceiling of the current Fee Setting Strategy for Domiciliary Care to a blended rate of £24.02 per hour.

 

·      agree that packages that fall between the floor and the ceiling will receive an uplift of 10.53%, unless this level of increase takes the care package above the proposed ceiling level of £24.02 In such cases the level of uplift will be capped at £24.02. Unless a package has exceptional circumstances, any packages above the ceiling rate will not receive an uplift.

 

·      agree that if the current rate of a care package is already above the proposed new ceiling and has been agreed due to the exceptional circumstances surrounding the care package, the proposed uplift for these packages will be commensurate to the Real Living Wage Uplift and other related costs which has been calculated as 5.7%.

 

Direct Payment Agency Rate

 

Authorisation be given to

agree that the Direct Payments agency rate be uplifted to £19 per hour in line with the proposed new Domiciliary Care floor rate.

 

Administration of Uplifts

 

Subject to Recommendations being approved, payment of the uplifts be backdated as usual, so as to take effect from 1st April 2022 in respect of all contracts.

 

Variation in Contract
