An agreement was made pursuant to Section 165 of the Local Government Planning and Land Act 1980 between the Cardiff Bay Development Corporation and Cardiff City Council and whereby the Council agreed to take responsibility for Cardiff Harbour Authority undertakings and obligations under the terms of the Cardiff Bay Barrage Act 1983. Welsh Government subsequently assumed CBDC’s rights and liabilities under the Section 165 Agreement.

The agreement and subsequent variations set out the funding arrangements for CHA, its obligations and those of Welsh Government Ministers.

A report published by Local Partnerships in December 2019 titled Review of the Current Funding Arrangements for Cardiff Harbour Authority recommended that owing to the number of deeds of variations that have been agreed since 2000, a clear and consolidated version of the Section 165 Agreement be produced. Welsh Government Officers were tasked with leading a review exercise in order to arrive upon this position.
