RESOLVED: that

 

1.              the Preferred Bidder developer/operator consortium as identified in Confidential Appendix 1 for the development and operation of a new Indoor Arena and Travelodge Hotel at Atlantic Wharf, Cardiff Bay be appointed

 

2.            Agreement be given to enter into a Pre-Contract Service Agreement (“PCSA”) with the Preferred Bidder including approval of the associated cost underwrite as set out in Confidential Appendix 2 (Section 8), subject to Confidential Appendix 15.

 

3.            Authority be delegated to the Director of Economic Development in consultation with the Cabinet Member for Investment & Development to negotiate Heads of Terms with the Preferred Bidder in relation to the Development Agreement and to return to Cabinet for approval alongside the Full Business Case in summer 2021.

 

4.            Authority be delegated to the Director of Economic Development in consultation with the Cabinet Member for Investment & Development to complete the land acquisitions as set out in the land strategy attached at Confidential Appendix 3, including the negotiation and completion of the Agreement with ABP to release the restrictive covenant and permit the Arena to be built adjacent to the dock feeder in line with the Heads of Terms and independent valuations contained within the Appendices to this report; and the acquisition of the freehold interest in the former Pizza Hut site on Hemingway Road.

 

5.            Authority be delegated to the Director of Economic Development in consultation with the Cabinet Member for Investment & Development to negotiate terms with Travelodge and to return to Cabinet for approval of an Agreement for Lease, or as necessary, serve notice on Travelodge to avoid Compulsory Purchase Order implications at the break date.  

 

6.            the obligations that will be placed on the Council when Cabinet considers the Full Business Case in the summer 2021 as set out in the Conditions Precedent document contained within Section F of Confidential Appendix 1 be noted

 

7.            approval be given to the additional project budget as set out in Confidential Appendix 2 (Sections 6) to progress delivery of the Indoor Arena project to the next stage.

19/11/2020 - Recommissioning Of Domiciliary Care And Sessional Support Services - An Update ref: 1406    Recommendations Approved

On 23rd January 2020, Social Services presented a report which outlined the proposal for a new approach to the commissioning arrangements for the future delivery of care at home (domiciliary care and sessional support) across adults and children’s services. This report set out a procurement timetable to have the new contracts and system in place by 4 November 2020. At this time, Cabinet approved to delegate authority to the Director of Social Services for all procurement decisions related to the re-commissioning of the new arrangements.

 

Due to the COVID 19 pandemic response, which required significant support and guidance for the social care sector from the local authority, the timescale for this piece of work needs to be extended.

 

Due to the significant change of the proposed procurement timeline, as well as changes in leadership within the Social Services directorate, it is appropriate that this recommendation is reviewed at Cabinet level.

The Cabinet is recommended to:

 

1.            the procurement timeline approved by Cabinet in January 2020 that set out a November 2020 implementation date for new contracts be revised and agreement be given to extend this for a period till November 2021 at the latest to enable colleagues from the Commissioning and Procurement teams to re-engage with the sector as part of the previously planned consultation and test and learn sessions, and to complete of the Cost of Care exercise which is integral to the recommissioning exercise

 

2.            the extension of the current commissioning arrangements for Domiciliary Care, which uses a dynamic purchasing system entitled ‘Accredited Provider List for Domiciliary Care Services in Cardiff (‘AL’), be extended for a period of up to November 2021 to provide sufficient time for the new commissioning arrangements to be implemented to support the introduction of the new outcome –focused, locality –based domiciliary care model.  Subject to the agreement of the individual Providers concerned, the overarching agreements concluded between the Council and those providers appointed to the current APL will be extended to November 2021 at the very latest.

 

3.            authority be delegated to the Corporate Director of People and Communities, in consultation with the Cabinet Member for Social Care, Health &Well-being, Cabinet Member of Children and Families, the Section 151 Officer and the Director of Governance and Legal Services for all future procurement decisions relating to the new arrangements, including the outcome of the Cost of Care exercise and the related Fee Setting Strategy, award of contracts  and all associated matters.

               II.     Undertake the statutory consultation process required in relation to the disposal of land off Ball Road illustrated by the site plan at Appendix 1 and to agree draft Heads of Terms and return to a future meeting of Cabinet for authority to complete the disposal.

 

2)            the capital receipt from disposal of the 3 parcels of land be ring fenced to deliver the proposed road link and bridge, the new Outdoor Sports Complex of Mendip Road, Llanrumney and other community initiatives in the Pentwyn and Llanrumney wards.

19/11/2020 - Council New Build delivery programme and the progression of phase 1 of the Channel View Redevelopment scheme. ref: 1398    Recommendations Approved

The Channel View redevelopment scheme is currently being consulted on ahead of a formal planning submission. The Cabinet must be briefed on progress and authority is being sought to move into the development/delivery stage. Subject to a planning permission being granted, a contractor needs to be procured for phase 1 and empty property needs to be demolished.

 

Furthermore, the development pipeline for the additional build programme (outside of Cardiff Living) needs to be discussed and approval is being sought from Cabinet to tender for contractors for projects above £5 million in value.
