18/11/2021 - Disabled Adaptations (Changes to the Regulatory Reform Order ref: 1621    Recommendations Approved

The Welsh Government have made additional funding available to undertake low level disabled adaptations, as a condition of this funding no means test will take place and disabled clients will not need to contribute to the cost of the adaptation.  The value of the additional funding exceeds the cumulative value of client contributions that are collected. It is necessary to make amendments to our Policy under the Regulatory Reform Order to allow for this change before the end of the current financial year.

b)           Transfer the assets of the Norwegian Church Preservation Trust to the Norwegian Church Cardiff Bay Charitable Incorporated Organisation as outlined in this report.

 

c)            Write off any outstanding debts of the Norwegian Church Preservation Trust in advance of the transfer.

 

d)           Dissolve the Norwegian Church Preservation Trust once the transfer of assets has taken place.

18/11/2021 - Sustainable Drainage Approval Body (SAB) Adoption and Future Maintenance of Sustainable Drainage (SuDS) Features ref: 1617    Recommendations Approved

Schedule 3 of the Flood and Water Management Act 2010 places a mandatory requirement for the Unitary Authority, acting in its capacity as a SuDS Approval Body, to adopt drainage systems that are constructed in accordance with Welsh Government Standards for Sustainable Drainage and approved proposals.

 

Since the introduction of the legislation in January 2019, for qualifying developments the two main options for SuDS maintenance are:

 

  • A Management Company that will maintain the SuDS features. The funding will be paid directly to the management company through a continuous maintenance charge on all property owners.

 

  • A Commuted Maintenance Sum is paid by the developer to the Council to allow for future maintenance of SuDS features be undertaken by the Council.

 

It is considered that the spirit of the legislation is to ensure that a single statutory body is responsible for the maintenance and inspection of SuDS features. Therefore, Cardiff Council as the SAB is the statutory body responsible for ensuring that the drainage system is maintained and inspected.

18/11/2021 - Updated Gypsy and Traveller Accommodation Assessment ref: 1622    Recommendations Approved

The Council is required under Part 3 of the Housing (Wales) Act 2014 to undertake a Gypsy and Traveller Accommodation Assessment (GTAA) and to make provision for sites where the assessment identifies an unmet need for Gypsy and Traveller pitches. The first GTAA was approved by Welsh Ministers in 2016 and in accordance with the Act Local Authorities must update the GTAA every 5 years, This update is required to be submitted to Welsh Government by February 2021 and in order to meet this deadline an update to the GTAA has been undertaken. This report outlines the findings of this update and seeks approval to submit this to Welsh Ministers for approval.
