Appendix 2 is exempt from publication pursuant to paragraph 16 of Part4 of Schedule 12A to the Local Government Act 1972

Agreed: that authorisation be given to:

•    The tender of 6 contracts to support the recruitment of care workers and the delivery of home care hours as detailed in the body of this report;

•    the proposed model for the Cardiff Care Development Service as set out in the body of the report; 

•    the proposed evaluation criteria as detailed in the body of this report;

•    the procurement methodology as detailed in the body of the report;

Agreed: that approval be given to the procurement of the ARC network infrastructure and ARC hardware and software systems as outlined in the report.  Total contract values are detailed in Paragraph(s) 19 & 20 of this report.

Agreed: that a procurement process for supply and installation of audio visual equipment across the school estate be authorised

The report will outline the overall financial monitoring position of the Council in respect of both revenue and capital accounts.  This will include and analysis of key variances based on the first six months of the financial year.

RESOLVED: that

1.                  the projected revenue financial outturn based on the projected position at Month 6 of the financialyear be noted

2.                  the capital spend and projected position at Month 6 of the financial year be noted

The Welsh Government have made additional funding available to undertake low level disabled adaptations, as a condition of this funding no means test will take place and disabled clients will not need to contribute to the cost of the adaptation.  The value of the additional funding exceeds the cumulative value of client contributions that are collected. It is necessary to make amendments to our Policy under the Regulatory Reform Order to allow for this change before the end of the current financial year.

RESOLVED: that

1.               Agrment be given ee to introduce an alternative discretionary adaptation grant (DAG) that will be an alternative to the mandatory grant system thereby removing the requirement for a means test in relation to the provision of disabled adaptations.

authority be delegated to the Director Adults, Housing and Communities, in consultation with the Cabinet Member for Social Care, Health and Wellbeing, the section 151 Officer and Director of Governance and Legal Services, to update the Private Sector Housing Policy under the Regulatory Reform Order in line with this change and other administrative changes.

This report will present to Cabinet proposals for the potential transfer of the Norwegian Church to a community-led organisation led by the Welsh Norwegian Society, and outline the next steps for progressing the proposal.

Appendices 3, 4, 5 and 7 of this report is not for publication as it contains exempt information of the description contained in paragraphs 14 of part 4 and paragraph 21 of part 5 of Schedule 12A of the Local Government Act 1972.

RESOLVED: that authority be delegated to the Director of Economic Development, in consultation with the Cabinet Member for Investment & Development, the Section 151 Officer and the Legal Officer to:

a)           Conclude the leasehold disposal of the property known as The Old Library, Trinity Street marked red on the site plan attached at Appendix 1 to the preferred bidder outlined in this report and in line with the Heads of Terms set out in Confidential Appendix 5.

b)           Transfer the assets of the Norwegian Church Preservation Trust to the Norwegian Church Cardiff Bay Charitable Incorporated Organisation as outlined in this report.

c)            Write off any outstanding debts of the Norwegian Church Preservation Trust in advance of the transfer.

d)           Dissolve the Norwegian Church Preservation Trust once the transfer of assets has taken place.

To note the monitored results gathered in 2020 and recommend the finalisation of the 2021 Annual Progress Report for submission to Welsh Government for approval.

RESOLVED: that

1.            the monitored results gathered in 2020 be noted and accepted and the 2021 Annual Progress Report (as attached as Appendix 1 to the report) be approved for submission to Welsh Government for approval.

2.            authority be delegated to the Director of Planning, Transport & Environment in consultation with the Cabinet Members for Clean Streets, Recycling & Environment and Strategic Planning and Transport, the Section 151 Officer and the Council’s Monitoring Officer to determine all aspects of the procurement process for the 2 year pilot project on a city wide real-time monitoring network (including approval of the evaluation criteria and authority to award contracts) and all ancillary matters pertaining to the procurement.

Schedule 3 of the Flood and Water Management Act 2010 places a mandatory requirement for the Unitary Authority, acting in its capacity as a SuDS Approval Body, to adopt drainage systems that are constructed in accordance with Welsh Government Standards for Sustainable Drainage and approved proposals.

Since the introduction of the legislation in January 2019, for qualifying developments the two main options for SuDS maintenance are:

• A Management Company that will maintain the SuDS features. The funding will be paid directly to the management company through a continuous maintenance charge on all property owners.

• A Commuted Maintenance Sum is paid by the developer to the Council to allow for future maintenance of SuDS features be undertaken by the Council.

It is considered that the spirit of the legislation is to ensure that a single statutory body is responsible for the maintenance and inspection of SuDS features. Therefore, Cardiff Council as the SAB is the statutory body responsible for ensuring that the drainage system is maintained and inspected.

RESOLVED: that

1.           the mandatory requirement to adopt SuDS features be noted

2.           the in-house service model (as described in the report) to manage and maintain these features on all qualifying developments funded by commuted maintenance sums be approved

Approved

The Council is required under Part 3 of the Housing (Wales) Act 2014 to undertake a Gypsy and Traveller Accommodation Assessment (GTAA) and to make provision for sites where the assessment identifies an unmet need for Gypsy and Traveller pitches. The first GTAA was approved by Welsh Ministers in 2016 and in accordance with the Act Local Authorities must update the GTAA every 5 years, This update is required to be submitted to Welsh Government by February 2021 and in order to meet this deadline an update to the GTAA has been undertaken. This report outlines the findings of this update and seeks approval to submit this to Welsh Ministers for approval.

RESOLVED: that the Gypsy and Traveller Accommodation Assessment be approved for Submission to Welsh Ministers for approval.

Agreed: that

1.    Approval be given to the proposed overarching evaluation criteria as detailed in the body of this report

.

2.    the commencement of the procurement be authorised and  the Find a Tender service contract notice and PQQ/ITT documentation be issued

Agreed: that the establishment of the 2FE entry dual steam primary school with nursery provision to serve the early phases of the Plasd?r development be delayed from the planned implementation date of September 2021 to September 2023.

Agreed: that the Council  dispose of its freehold interest in 85-87 Harris Avenue, Romney, Cardiff, CF3 1QB.

Agreed: that

1.  the outcome of the evaluation process as set out in Appendix A in terms of the bidders ranking be noted

2.  officers be instructed to inform those parties that tendered in this matter (as well as those who expressed an interest in this matter) of the outcome of the evaluation process and proposed way forward (as detailed in this report).

Subject to the satisfactory conclusion of the standstill period, a Framework Agreement be concluded with the organisations highlighted in Appendix A

AGREED: that it be agreed that Cardiff Council offer a town centre loan to Parador 44 Ltd of £770,000 towards the purchase and redevelopment costs associated with 14-15 Quay Street, subject to pre-conditions being satisfied set out in the legal agreement.  

Appendix 1 is exempt from publication as it contains information pursuant to paragraph 16 of the of Part IV of schedule 12 A of local government Act 1972.

Agreed: that

1.   the proposed procurement route be authorised and approval be given to invite tenders via the SEWSCAP 3 Lot 7 Framework Agreement in order to procure a contractor to construct a replacement early years unit and new flying start unit with community room and crèche provision, plus a Specialist Resource Base for 20 pupils.

2.   the evaluation criteria set out in the report be approved

The Legal advice set out in appendix A to this report is exempt from publication pursuant to Paragraph 16 of Part 4 of Schedule 12A to the Local Government Act 1972

Agreed: That the Bus Travel Incentive Scheme as set out in the report be approved.

Appendix 1 referred to in the body of the report is not for publication as it contains exempt information of the description in paragraph 14 (Information relating to the financial or business affairs of any particular person (including the authority holding that information)) of Part 4 of schedule 12A and paragraph 21 (the public interest in maintaining the exemption outweighs the public interest in disclosing the information) of Part 5 of schedule 12A of the Local Government Act 1972 (as amended).

Agreed: that approval be given to progress to stage two of the procurement strategy and to approve selection of the five contractors below who will receive the invitation to tender for the second stage
