AGREED: that
(i) Approval be given for Wates Residential to progress onto phase 2/3 of the Cardiff Living development programme identified under the Development Agreement.
(ii) changes to the Development Agreement and its schedules and the updated JCT 2016 D&B build contract with amendments as set out in this report be approved.
Reasons for the decision:
The first phase of Cardiff Living is still ongoing but to ensure a continuous programme, and further to the Cabinet Approval in principle, approval is now being sought to enable Wates to progress onto phase 2/3 and commence on site in summer 2020.
To progress onto phase 2/3 it has been necessary to make changes to the Development Agreement as set out in this report, and subject to it approval, this the parties have agreed and will enter into a form Deed of Variation The JCT 2016 D&B form of contract and amendments have also been agreed between the parties.
